1) Booking requests and contract formation
A booking request is an inquiry. Submitting a request does not guarantee availability. A contract is formed only when we confirm the booking and provide the agreed details.
For distance/online contracting, you are provided with pre-contract information sufficient to identify the business entity and the transaction details, in accordance with Law of Ukraine “On the Protection of Consumer Rights” dated 10.06.2023 No. 3153-IX (in particular Article 17).
If any portion of the offer is presented online and/or results in commercial electronic communications, we provide identifying information required by applicable law, in accordance with Law of Ukraine “On Electronic Commerce” dated 03.09.2015 No. 675-VIII (in particular Article 7).
2) Itineraries, schedules, and changes
Itineraries are provided as guidance. Schedules and included activities may change due to operational needs, weather, supplier availability, safety, or force majeure. Where changes are made, we will use reasonable efforts to notify you and provide alternatives when feasible.
3) Availability is not guaranteed
Availability shown on the site may be updated without notice. We do not guarantee availability until we confirm your booking.
4) Your responsibilities
You must provide accurate information for the booking request and follow instructions relevant to the service. You are responsible for ensuring that any documents required for participation are valid.
If you have health conditions or restrictions, you should inform us before booking so we can assess suitability. You remain responsible for your own decisions regarding participation.
5) Personal data and consent
We process personal data to manage inquiries, booking requests, and service delivery. Processing is based on consent or another lawful basis and is carried out in line with the consent concept under applicable Ukrainian law, in accordance with Law of Ukraine “On the Protection of Personal Data” dated 01.06.2010 No. 2297-VI (in particular Article 11).
6) Advertising and no misleading claims
Any promotional materials and offers are provided without misleading information and comply with Ukrainian advertising requirements, in accordance with Law of Ukraine “On Advertising” dated 03.07.1996 No. 270/96-VR.
7) Liability limitations
To the maximum extent permitted by law, kernelwavering.com and its representatives are not liable for indirect damages, lost profits, or losses arising from circumstances beyond our reasonable control (including force majeure). Our liability related to the services is limited to direct documented losses attributable to our breach, except where liability cannot be limited by law.
8) Service delivery and cancellations
If you need to cancel a request, notify us as soon as possible. Cancellation terms depend on the type of service and any supplier commitments. Where applicable, we will inform you of the relevant conditions during confirmation.
